By purchasing NFTs from the Swiss NFT Association, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this Notice.

SALE OF NON-FUNGIBLE TOKENS ('NFTs')

This Legal Notice ('Notice') is issued by the Swiss NFT Association ('Association'), an association duly incorporated and validly existing under the laws of Switzerland registered under number CHE-290.850.746, in connection with the sale of DLT-based cryptographic non-fungible tokens ('NFTs'). By purchasing NFTs from the Association, you ('Purchaser') acknowledge and agree to the following terms and conditions:

1. Membership Application

1.1. The purchase of NFTs issued by the Association constitutes an application to become a passive member of the Swiss NFT Association.

1.2. Purchasers of NFTs shall have no voting rights within the Association.

2. Membership Benefits

2.1. The Association shall provide membership benefits to the Purchaser as described in official communications and on the Association's website.

3. Non-Financial Instruments

3.1. NFTs sold by the Association do not constitute financial instruments and shall not be purchased for investment purposes.

4. Consideration

4.1. The consideration paid by the Purchaser in connection with the purchase of NFTs shall be considered the annual membership fee of the Swiss NFT Association.

4.2. Purchases of NFTs are non-refundable.

5. Membership Duration

5.1. Membership in the Association, obtained through the purchase of NFTs, shall be valid for one (1) year from the date of purchase.

6. Risk Disclosure and Limitation of Liability

6.1. The Purchaser acknowledges and accepts that there are risks associated with utilising an internet-based system, including, but not limited to, the failure of hardware, software, internet connection, servers, and third-party infrastructure, applications, networks and protocols. The Purchaser acknowledges and agrees that the Association shall not be responsible for any failures, disruptions, errors, distortions or delays you may experience when purchasing the NFTs, however caused.

6.2. Purchasers are expressly advised that the value of NFTs may be highly volatile and can fluctuate significantly. There is a risk of losing the entire value of the NFTs purchased.

6.3. The Association does not provide any guarantees or warranties regarding the future value of NFTs.

6.4. To the fullest extent permitted by law, the Association, its officers, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the purchase of NFTs.

6.5. The Association's liability, if any, shall be limited to the purchase price of the NFTs.

7. Governing Law and Jurisdiction

7.1. The purchase of the NFTs is governed by Swiss law. Any disputes arising out of or in connection with the purchase of NFTs shall be subject to the exclusive jurisdiction of the competent Swiss courts.

8. Modification of Terms

8.1. The Association reserves the right to modify, amend, or update these terms and conditions at its discretion. Such changes shall be effective upon publication on the Association's official website.

References and links on third-party websites are outside of our area of responsibility. Any responsibility for these websites is rejected. These websites are accessed and used at the user's own risk.

Copyrights

The copyrights and all other rights relating to content, images, photos and other data on the website are owned exclusively by the Swiss NFT Association. The written approval of the copyright holders must be obtained in advance for the reproduction of any element. A violation of the copyright of the Swiss NFT Association shall result in civil and criminal proceedings.
